Neither homeowner, nor the au pair should be charged. The 14 year old should be charged with this misdemeanor in Family Court. He, after all, was the host of this party. I'd assume he was the one who invited the other kids, provided the alcohol (or at least the place to drink), and did not call an adult when things got out of hand. Yes, he is a child, but again he was the host and that is what family court is for.
If in fact the person charged is not the au pair and is just a student living there, the parents should be responsible for leaving their child with insufficient supervision. I believe they underestimated his level of responsibility and now are paying the price. I don't think this will ever happen again to this family. If she is the au pair she is being paid to supervise the teen and obviously failed to do her job and she should suffer the consequences both legal and personal.
