Another great segment. I have agreed with just about every one of your commentaries. Thanks for being the voice of reason and especially for talking so much about the absurdities of this war.

I completely agree with all of your views regarding the war . The government is just absurd in the way they treat our men in uniform as opposed to the enemies were supposed to get rid of . I just think it so ridiculous .

Well just like the 2 minutes soundbites we are all now accustomed to get from the tv news shows I bet you have left quite a bit out. Murder is wrong no matter who is at the receiving end of it, that is what make this country and its people different from the rest of the animals in the pen. Provide the details, peel the onion and do due diligence if not in your 2 seconds you have on the news then at least in another medium, but for god's sake stop treating us like idiots that can not think or process. The Lt may indeed be innocent but your comments are not advancing his cause. You know that i am right so be good enough to admit it.

This story really upset me. I am so glad my husband who is in the Army is getting out after 22 years of service. This is the new military where our government cares more for our enemies. Yeah this really makes a lot of sense just catch the enemy give them a stern talking too and then make them promise not do it again. People wake up you think 9/11 was bad. Now let's just wait and see when one of those "catch and release" guys does something worst here in New York City.

This is a very complex issue:

Firstly, I don't approve of any policy that gets people released on their word alone. That is just stupid. I am assuming this was probably started due to some logistical reasons, perhaps the military doesn't have the personnel or the resources to deal with all the people they are capturing so they have to let some go. Even if this is the case its clearly a stupid policy.

Second, with respect to the 23 year old that was released; we don't know that he was going to use those thing in his yard for attacking our troops. I know the simpleton will rush to argue that his intentions are self evident. However, you have to consider the region and the culture. Everyone that lives in that region owns fire-arms and or explosives its a hostile environment and they do have a huge opium problem in the country. So it is possible that man just happened to have those things on him and had no malicious intent. Should they have released him, OF COURSE NOT! Not without adequate investigation. But critical thinking and reason requires that we not make blind assumptions without considering all the facts. If someone had those things on them and they lived in Long Island I would say "watch that guy!" but in the war torn regions of the war its to be expected.

Lastly, with regards to Lt. Behenna; he committed a murder (as far as the first trial is concerned). Should he get another trial? I think in light of the circumstances another trial is not unreasonable. However, we have to acknowledge that whether or not the killed Mansur was guilty of killing our troops is ultimately irrelevant in this case. Behenna was given AN ORDER (A STUPID ONE! YES!!! BUT HE WAS GIVEN AN ORDER). In the military you follow orders, you don't have the luxury of deciding what to do about someone or something, even if you think its not fair.

I don't like that they let Mansur go either but just like it wasn't up to me, it wasn't up to Behenna. Consider this scenario: We all pretty much know that OJ killed his ex-wife and essentially got away with it. Does that mean that because I don't like the verdict that I have the right to find OJ and murder him? No, I have to accept the fact that he killed someone and the system failed. I do not have the right to ignore the law and take justice into my own hands just because I know he is guilty. Similarly, IF THE PROSECUTION IS RIGHT IN THIS CASE then Behenna is in effect a murderer and Mansur's alleged crimes are irrelevant. It Sucks but that is the negative side of rule of law.

Personally I think there is too much restriction on our troops. Just the fact that they are not allowed war trophies bothers the hell out of me but basically THOSE ARE THE BREAKS.

your silly analogy of the holocaust with the release of a prisoner is to skewed and irrelevant that it doesn't warrant an intellectual response and if you cant debate an issue without resulting to childish personal attacks then you should stay out of the debate. The fact is that in order to be a functioning military you cannot act as rouge agents. You must follow orders, if your commander orders you to storm the beach; you may not like it and think its a poor tactical decision that will get you killed but you are expected to do it! Come on your more rational then that. I already explained in my initial post why he could have had those explosives. The region is in of itself volatile even without US presence. Presumption without investigation is not proof. Which is why I say they should have detained him further until a legitimate case was built.

If he killed someone regardless of the persons crimes and in a military context he was not authorized to kill that person then its murder. He had a motive (revenge) and he acted on it. Maybe that murder was justified, that is a separate issue. The fact is a man is dead and if he was killed by Lt. Behenna and Behenna was not authorized by the military to make the kill then its murder. Its one thing if he killed him in combat or the guy attacked him or something like that but the first trial obviously concluded that this was not the case. You have to abide by the rule of law (even in the military). Are there grounds for appeal and another trial? I would say "Yes, absolutely" but core questions of that 2nd trial would be:

Was this murder or self defense?

Was Behenna the only one responsible for the mans death?

Did Behenna violate military practices and procedures and did those violations ultimately lead to Mansur's death?

Was Mansur killed in some kind of physical altercation with Behenna?

If it is found that Behenna willfully ignored direct orders to release Mansur and essentially took it upon himself to deliberately end Mansur's life then THAT IS MURDER... regardless of what Mansur may have done.

If someone kills say a mass murderer then its still a murder regardless of its justification. The law did not give that man license to kill the killer. Similarly, all indications are that the military did not give Behenna the authority to decided whether or not to allegedly kill Mansur. But nonetheless he is dead and someone must be held accountable for that.

It may be the case for civil area, but this is a different story.
I really hate when politics gets in the way. And even when the military is not the govt, but there is still bureaucracy there because the whole thing is so big.
I don't think it is really any wrong for the kill, the "unauthorized" is probably because of military red tape, procedures, or just the PC again.
Often time the soldiers can make the move, nice and easy, but because of procedure, it was held back, or even completely called off.
I am not telling soldiers to disobey orders, but it is often the bureaucracy that failed the mission.

Lt. Behenna should be getting a medal for eliminating a member of the taliban. This is a sad story to hear what is happening to him. Thank you for sharing this story, God bless Lt. Behenna and our military. They have a difficult job to do everyday. One less taliban member is one less problem we have to deal with later.

I say release him, because he did NOT commit murder. He was just doing his job. Another trial would just say he was "guilty", before proving him innocent. It isn't necessary to do this on the taxpayers time and money. Why are we so ready to be SO HARD on our own men?

Your commentary on this issue is too infrequent causing the matter to relentlessly entrench and snare anyone left (pardon the expression).

This culture has to manage functioning in the land of opposites, the bad guys being victims, and folks protecting themselves from being exploited in any form risk strident accusations of being 'insensitive', 'racist', 'homophobe', or whatever the flavor of the day is.

Who would see happening that our military, uniformed personnel, and responders, risk having that government they believed they served actually is serving someone/something else.

Personally, one of my interpretations of the Constitution and its founders were quite metaphysical in preparing that document. They were keenly aware that ALL GOVERNMENT -- by definition -- is seeded with its own undoing.

That's why they put the First Amendment FIRST: If and When all the other provisions become tainted, we can hold fast to very first; at least one!

I hope I was clear expressing these points.

A military tribunal found him guilty, so his actions were clearly not standard procedure and he was not "just doing his job". And you can't "just release" somebody after a judicial proceeding found him guilty.

Larry, I find your simplistic logic to be the lowest form of journalism. Your elementary analogies are simply wrong. You should try giving greater context or conceding certain issues have more complexity than you may understand.

No trial, no anything, just release him. He is not guilty of anything. I hold on to that opinion.

To those above who say I have not given enough context - understand that I have two minutes to give my opinion - explain the back story - and still be interesting.

I count on people to be interested in the topic and then go find out more about it.

There is plenty of information out there, but since some of you have decided to criticize without informing yourselves - let me illuminate:

On March 20th, 2009, Army Ranger 1st Lieutenant Michael Behenna was sentenced to 25 years in prison for killing Ali Mansur, a known Al Qaeda operative while serving in Iraq.

Mansur was known to be a member of an Al Qaeda cell operating in the lieutenant’s area of operation and was suspected to have organized an attack on Lt. Behenna’s platoon in April 2008 which killed two U.S. soldiers and injured two more.

Lt. Behenna captured Masnur and brought him in for questioning. Army intelligence ordered the release of Mansur and Lt. Behenna was ordered to return the terrorist to his home.

During the return of Mansur, Lt. Behenna again questioned the Al Qaeda member for information about other members of the terrorist cell, and financial supporters. During this interrogation, Mansur attacked Lt. Behenna, who killed the terrorist in self-defense. The government subsequently prosecuted Lt. Behenna for premeditated murder.

April 21, 2008: Lt. Behenna’s platoon was attacked by Al Qaeda operatives. The attack resulted in death of two of Lt. Behenna’s platoon members, two Iraqi citizens, and wounded two additional soldiers under Lt. Behenna’s command.

May 5, 2008: Known terrorist Ali Mansur was detained at his home for suspected involvement in the attack on Lt. Behenna’s platoon

May 16, 2008: Army Intelligence orders the release of Mansur

Lt. Behenna, who lost two members of his platoon just weeks earlier, was ordered to transport Mansur back to his home

Lt. Behenna attempts a final interrogation of Mansur prior to his release

During the interrogation, Behenna says he was attacked by Mansur and was forced to defend himself. During the altercation, Mansur was killed.

Lt. Behenna failed to properly report the incident

July 2008: The U.S. Army charges Lt. Behenna with premeditated murder for the death of Al Qaeda operative and suspected terrorist Ali Mansur.

February 23, 2009: Lt. Behenna’s trial begins

Government and defense experts agree on the trajectory of the bullets killing Mansur

Prosecution expert Dr. Herbert MacDonnell initiated contact with defense attorneys explaining his agreement with the testimony of Lt. Behenna and his presentation to prosecutors supporting Lt. Behenna’s version of events.

Dr. MacDonnell is not called to testify in the case and instead is sent home. Just before leaving the courthouse he picks up his coat from the prosecution room and says to the three prosecutors (Megan Poirier, Jason Elbert, and Erwin Roberts), ‘The explanation that Lt Behenna just testified to was the exact same scenario I told you yesterday. Lt Behenna is telling the truth.’

Jack Zimmermann, defense counsel, asks prosecutors if they have any exculpatory evidence that should be provided to the defense (referring to Dr. MacDonnell’s demonstration). Prosecutors deny having any such evidence despite having been told by their own expert witness that Lt Behenna’s explanation was the only logical explanation.

Prosecutors withholding of this evidence allowed them to argue that Lt. Behenna executed Ali Mansur while seated when the forensic experts, including Dr. MacDonnell, agree that Ali was standing with his arms outstretched when shot

Lt. Behenna is convicted of unpremeditated murder and assault by a military panel of seven officers, none of whom had combat experience.

Dr. MacDonnell contacts prosecution requesting that the information provided in his demonstration be given to the defense.

Prosecutors provide such information SAFTER a verdict was rendered, but prior to sentencing.

At the request of the presiding judge, Dr. MacDonnell provides his information to the court via telephone

The judge orders both sides in the case to file briefs relating to a possible mistrial

After reading the briefs the judge set an additional hearing and ordered additional briefs, including one from the defense requesting a new trial.

On March 20, the judge denied defense motions to declare a mistrial and to order a new trial

Lt. Behenna was paraded in handcuffs through the Nashville airport, the Milwaukee airport, and the Kansas City airport enroute to Fort Leavenworth Prison

Lt. Behenna’s attorneys are appealing the verdict

Lt. Behenna is currently serving a 15-year sentence (the 25 year sentence was reduced five years by the commanding general of 101st Airborne and reduced another five years by the Army Clemency Board. The earliest he would be eligible for parole is after serving a third of his sentence. Without parole or a new trial Lt. Behenna will get out of prison for the shooting an Al Qaeda terrorist in self defense when he is 40 years old.

1st Lieutenant Michael Behenna was an excellent officer. He received his call to serve his country while attending the University of Central Oklahoma. He is from a family of public servants, his mother being an Assistant United States Attorney and his father a retired Special Agent with the Oklahoma State Bureau of Investigation. He has served the Army and the United States with honor and dignity.

Those are the facts of the case- a US Soldier with a previously impeccable record - is in prison for killing an Al-qaeda operative in Iraq.

Did he disobey an order? Yes. Did he fail to report the incident? Yes. For both of those actions he should be reprimanded.

I would argue that Army Intelligence, the Officer who ordered Behenna to take Mansur back and especially the prosecution all have some culpability here. There are enough problems with the case for, at the very least, a new trial.

And I believe we need to give our soldiers some benefit of the doubt and there is some doubt in this case. Now, do you agree?

Larry it is BECAUSE of men like Lt.Behenna, that we are free to Disagree on just about anything in this country.Even if we Disagree On Lt.Behenna.

Mass murderer Charlie Manson has a cult following. This is sick.

Some of his women followers felt "sorry" for what they did in the Tate/LoBianca murders, and were released earlier from jail. I know that one of them died from a brain tumor.

Since the murder victims were innocent, they had no say in the matter. Since they took away the death penalty in California, Charlie is still rotting in his cell.

I get sick if I see a teenager wearing a Manson teeshirt.

I think Lt. Behenna should be released of any wrong doing. Of course, this is not the same as the Manson case, but think about it.

A criminal becomes famous in jail, and a patriotic soldier has to go to jail.

This world is not a fair place. Behenna went to war for his country, and now he has to go to war to clear himself. NOT ON MY WATCH!

not only it does not seem fair - it down right does not make sense...

Yes, clearly there are grounds for a new trial. However, as far as the letter of the law is concerned there can be no "benefit of the doubt" for anyone. A legal proceeding must be completely objective.

We must also keep in mind the military is (as it should be and by its very nature) compartmentalized. As such, we don't really know why it was determined that Mansur was to be released it could just as easily be the case that Mansur was being tracked by the CIA or another secret military or government organization and his release was to be part of a larger covert operation and his death put the entire project in jeopardy.

The fact is, what Mansur did is IRRELEVANT. He was not to die. Army Intelligence (for whatever reason) wanted him alive. Behenna's duty was to obey the orders he was given. Now Behenna claimed self defense and given the 'mystery' witness that did not testify, I can see grounds for another trial.

But should a 2nd trial be granted and the findings are that Behenna did not act in self defense well then Behenna is a murderer. And it doesn't matter what Mansur was guilty of. Everyone will have to come to terms with that, and accept the reality that Behenna went rouge and killed someone in violation of orders from his superiors and thereby committed the crime of murder.

The reason this generation is so out touch with everything that matter is exactly that Larry, you have two minutes to deal with a serious matter. if as a newsman you don't feel you have enough time then pick another subject more in line with the majority of the audience such as the latest flavor at Starbucks. Lets face the majority of people watching have the attention span of a very small centipede. So don't insult the rest of us and don't hide behind the two minute bit.

Larry, your article and comments in this section greatly disappoint me. Your opinion is so far skewed and so far from the facts it is incomprehensible.

In a previous post you wrote "Those are the facts of the case- a US Soldier with a previously impeccable record - is in prison for killing an Al-qaeda operative in Iraq."

One of the "facts" that you mention includes "Mansur attacked Lt. Behenna, who killed the terrorist in self-defense." This is the farthest thing there is from fact. This was the very center of debate in the court case that followed.

What is even more appalling to me is all of the actual facts, that I am sure you are aware of, that you have decided to so conveniently leave out. For example, Lt. Behenna ordered his platoon to take an alternate route back to where he was supposed to release Mansur. He ordered them to stop, got him out of the vehicle and took him out of the line of sight from the rest of the men. At some point he stripped him of his clothing and interrogated him. What happened from there is uncertain but in the end Mansur was dead from gunshot wounds that came from Lt. Behenna's gun. You did say that Behenna failed to report the incident properly, but you also failed to mention that he decided to use an incendiary grenade to try and destroy the body and then bury it.

So, now that a few more of the facts are out there, maybe you want to count the number of times Behenna violated orders and acted on his own, which ultimately resulted in this human beings life being taken. Also, I don't know if Mansur attacked him or not and I do not pretend to know but I think most people would certainly understand that he tried to fight for his life once he was taken off the beaten path, stripped of his clothing, interrogated by a rogue soldier with no supervision and (presumably) feared for his life.

Now, as to my opinion, a man that does as he as told, breaks no laws and kills a man in self defense does not try to burn and dispose of the body of the man that he killed in self defense and then fails to tell any of his superiors about it.

I read the content on websites prior to when I leave a short review. If I have not one thing to say of the information topic, I wouldn't leave any evaluations. And I favor to read anyone else’s remarks on that post too. Because I will find practical ideas among the high-quality comments. I'd have posted “Fabulous blog! Extraordinary posts!” then I might possibly be spamming your blog. I too use a blog website, one thing I'd do every single day when i signed on to my blogging site is look into reviews to my threads and personally approve or reject these responses.
