Brooklyn Family Talks to Help Me Howard About MTA Metrocard Cutback

"I don't know how I'm going to send three children to school with minimal income".
That is the quandry for single mother Sacheen Henry and many other city families facing the loss of free metrocards provided by the MTA, as part of their planned cutbacks.
Sacheen has three children in the city school system. She drives a bus for senior citizens to make a living. The idea of paying another three to four thousand dollars to send her children to school now has her seriously thinking about home schooling, because she doesn't know how she'll afford that extra cost.
Help Me Howard sat down with the entire Henry family to get their views on the MTA plan. They foresee a rise in truancy when city kids can't afford access to school, which could lead to more serious problems.
Eldest daughter Nylasia says: "They're gonna have really high dropout rates.. When kids drop out they're usually on the street, which causes them to get locked up".
Sacheen fears that if the MTA goes thru with their plan, public school will no longer be an option for her kids, because their schools are not within walking distance.
Sacheen's 16-year old son Nysheem says since his school is all the way in Queens, if he can't get a metrocard, he probably won't go to school.
This is not what any parent wants to hear. Sacheen's kids already have other forces working against them in their educational options, it would be nice if their own local government was behind them.
Nylasia also worries about what her mother has to deal with on a daily basis: "I know she's struggling with her bills. But imagine her giving me $ 5.00 every day. She has to buy lunch for herself! She's tired and all of that money, all of that hard workin' money, it goes straight to bills! Straight to rent!
Right now Sacheen says she's more angry then scared: "I see that the city is doing drastic cutbacks on the backs of our children and our seniors. There are other methods, take some money out of your own pocket!"
As Sacheen sees it, the metrocard issue raises the ugly spectre of class and race, complicated and intensified by a brutal economy.
Sacheen says: The people who are wealthy and rich, they're not gonna have that problem. It's the minorities that are gonna ultimately suffer! It's my children and my neighbor's children and my neighbor in town. It's not gonna be the rich and the wealthy childnren. They're not gonna suffer.!

I agree with this situation. Student choose to go to schools that are far from their home. Every student has at least a school that is walking distance. If they choose to go to a school out of there zone or local area, then they should pay that fare. This will clear the space in the MTA train and buses, more room to ride.
I live in new jersey. I would never think to pay money before getting onto a school bus. If suburbs have free school transportation why isn't the great city of New York able to offer free school transportation?

I am outraged that children in this city will be required to pay for transportation to attend public school.
This city's government needs to sharpen their pencils and look elsewhere to replace diminished tax revenues!
How much do we spend per year for parades...I would love to see a ROI on the parade / street fairs that occur throughout the year. If they are money makers - fine - keep them (we can increase their frequency to pay for the childrens' transportation to school)...if not, these activities should be discontinued and the funds used to provide transportation for our children to get to school.
There are several alternatives available other than taking a metro pass from a child trying to get to school for the opportunity to create a better life!
There are enough distractions in this city for our children to overcome to attain their education... Shame on you.

First of all, Bless all of this world's children!!! Second, for all the rich and wealthy executives sitting on the MTA's board and who work for the MTA and make six and more figured salaries, give up your pay to pay the gap of mismanaged and improperly utilized funds and that should suffice for the MTA not to take more away from our children, seniors, or disabled... but from the MTA's executives fat wallets. Stop using the poor and/or hard working middle income families as scapegoats for your cutbacks and give up some of your salaries...or better yet lets swap jobs you sit in my seat with your family in my neighborhood/community and let your children walk in these frigid temperatures to school and I will sit in your executive chair making decisions that will affect more people like you!!! What a great idea!

its crazy how we got a billionaire mayor. why cant he take some money out of his pockets and help pay. I currently attend school at the SUNY Buffalo School of Management and throughout my previous educational experience while living in New York, I have always been able to use a complimentary metro card to make my living expenses and life substantially easier. Why impend the additional cost of transportation and make it cumbersome for students that must deal with other expenses such as books and school supplies? Can't we make the exception to help provide for the students of the future?
I pray and hope that kids do not have to pay to go to school. Its ashamed that they will target kids to help closed a budget gap that have nothing to do with.
I don't like it when they start using the BS race card in connection with the MTA student bus passes. Why the race card? You mean to tell me that these kids or the parents can't afford to pay either 25 or 50 cents towards their fare. If they can't afford that then answer this question, where the hell do they get the money for the boom boxes, cell phones, i-phones and i-pods? Or do they steal them from another kid? Or, where do they get the money for the designer sneakers that they can't figure out how to tie them up to the top, or where do they get the money for the pants that goes down to their feet and we are subjected to seeing their collar full underwear? Please, give me a break. The MTA has big time money problems, to make these kids pay either 25 or 50 cents towards each trip when they are going to school is not the end of the world. Please do not feel sorry for them. They have the money to piss away on every thing else.
It's easy to blame the MTA for their own mess and mismanagement, but they ARE a business and can run it anyway they want. What is hard is fighting harder to improve our neighborhoods and schools within those neighborhoods. Why is NO ONE fighting this hard to improve their own nighborhoods and schools? There really is NO need to overcrowd busses and trains with kids. Kids can go to school in their own neighborhoods and take pride in the area they live in and helped make prosperous. It would probably teach them one thing many of their parents haven't, RESPECT! Respect for others, the elderly and others property. There is NO need or viable reason to have a D student from the Bronx traveling 1 1/2 hours to school in Brooklyn only too maintain that D average. If he went to school in his own neighborhood he may care a little more and want to improve himself! I guess the right/easy solution is never the best one!
The American Way: Go to school, get an education, get a job, raise a family and pay taxes!
The GHETTO way: Don't go to school (but expect a free pass to get around the city), don't get an education (but can figure out how many grams are in an ounce of cocaine), get pregnant with 6 kids (because hey, welfare pays more for more kids) then collect welfare (free housing and food!) Then complain more because the free ride is ending!!!
I'm glad to see a few others feel the way I do. The only ones crying about this are minorities, specifically single mothers. Maybe they should have thought about this before they spit out a few kids. It's a choice to have children, a choice to have as many or as little as you want, a choice to live in a city or the suburbs or the country. Life is a choice.
I spent 12 years in Catholic school where my parents paid for my tuition bc there wasn't much of a choice in this city. They never expected the govt. to provide an education for me. They didn't create children they wouldn't be able to later on afford.
Where is the father (or dare I assume fatherS) of Ms. Henry's children? Don't they have a financial responsibility to their spawns? I know I don't and quite frankly, I'm more than a little sick and tired of having to suppor this nonsense.
Considering the majority of students don't even graduate, can someone please explain to me what we are even paying school taxes for? NYC should have at the very least a 95% graduation rate. It doesn't and at the rate we are going, won't.
Finally, it's always amusing to see how parents claim they can't afford anything for their child's education but the children never lack for designer clothes, $100+ sneakers and all the latest electronics.
Some of you who commented here go to public school. After reading some of these comments, this is EXACTLY why I have an issue paying for your education.
To Samantha Negron: Your mother is able to afford a computer and Internet service, then your mother should be able to afford a few bucks a year to send you to school. In addition, pay some attention in English class. Where is your father? Doesn't he have a financial responsibility for your well being or are you just another one of the many minority kids in this city who is fatherless?
To Melissa: Let's try to be a lady and leave the four letter words out of the comments. And like Samantha, you also need to pay attention in English class. You are another reason why I don't want to pay school taxes and I certainly don't want to pay for your transportation. And no Melissa, you don't deserve "the best education". You are correct that the kids choose the High school they attend, but at the same time the reason the kids choose a school far away is because the school that is within walking distance doesn't provide the education needs that can help our kids, who are our future become all they can be.Taking away the metrocard from kids isn't going to cause less congestion. When I was in high school I chose a school that wasn't within walking distance because that school offered me more that just an academic diploma,I was able to travel, meet people from different areas, backgrounds and cultures. I was lucky to become certified staight out of high school. Taking away the school kids metrocard will cause the drop out rate to increase big time, due to the fact the parents won't be able to afford the cost of sending their child(ren) to school, there will be more kids hanging out getting in trouble, leading to a high crime rate and more arrests of our young people.

These kids are our future at this rate I'm scared because what happens in the future, not everyone is fortunate enough and have the funds not to be affected by this drastic proposal.

I am a grandmother rising two high school student,and it is hardship rising these kids, and having to buy two cards 89.00 dollars a pop is a lot,if there are any protest i will be there.

And even though i go to school in brooklyn that doesn't mean anything.That still doesn't give me a rite to pay for school far. If Its called "public School" which is a school of free cost. I have children in the public schoolt system that need those metrocards to get to and from school, after-school and home and YES they do go to school out of their districts (we live in the Bronx and go to school in Manhattan) because the schools they are enrolled in are richer in academic programming than the ones in our immediate living area. This is unfair to their educations, not all schools have the same academic backing therefore I do choose to put them in a school that is out of their district so that they may have a chance to have a strong educational background. I will not put my children where academically a certain school is lacking...would you? Ask yourself that question and put yourself in my shoes. I work for Con Edison and make $34,000 before taxes, pay a $900 a month rent for a one bedroom apartment, pay utilities, food, clothing all which are my responsibility and handle it with pride but we have people on Public Assistance that don't do anything and they get everything so YES I will protest against this injustice! This is cruel to our children that look to better themselves and will have to be transferred back to a zone school that may not be academically challenging enough for them!

I disagree with charging students to ride a bus to school There is not a high school within walking distance to my home and I have two teenage step-sons that go to high school. Their father is un-employeed at this time and we are living on my income only. We could never afford to pay for both of them to ride the bus to and from school every day. That would cost us $50 a week not including the cot of my commuting to my job and the money needed for the dad to go out and look for work. What bill does the MTA think we should stop paying so our kids can get a education. I would not mind paying a few cents extra for a gallon of gas if I knew that the money would be going towards keeping the free bus passes for school children.

How much more can this cities government cut from the school system? Sport and extracurriculars are being cut and Advanced placement courses are also being cut...pretty soon they'll be saying that students have to pay for a chair to sit on during lessons....

There is a lot of ignorance going on here. This ignorance stems from the people who believe that students should not get metrocards. What about the kids who live in shelters? How are they expected to get to school. Some New York City adults show no support to children in any way shape or form. WELL GUESS WHAT I am affected and so are my children! I am a full time student and my husband works very long hours to get us by! My kids travel to go to school, as the elementary school, well wait no there are 3 schools by me that had waiting lists for the 4th grade??? I was NOTY going to leave my son out of school. Also he has speech and developmental problems, and his school is one of the best equiped schools to help him! I have my kindergarten in this school as well because well its easier to travel to one school then two different ones!! Mr. Anthony Passaro, Jr. was moved to a medical facility upstate, 5 hours away from his disabled father, Anthony Passaro, Sr., his mentally disabled sister, Anna, his disabled children and his disabled 93 year old grandmother, thus making it very difficult for these family members to visit him.
The coordinator of this said facility deemed Passaro Jr., to be medically/physically and mentally incompetent to open his own mail.
Mr. Passaro, Jr. was sent a letter by his lawyer. He was not only unable to physically open the correspondence, but he is mentally and cognitively unable to process the content.
Mr. Passaro, Jr., was sentenced to 25 years to life in state prison for 2nd degree murder by Judge Roger Mc Donough. Judge McDonough was judge and jury during the trial. As per the judge, Mr. Passro,Jr., was offered a trial with a jury but refused. However, Mr. Passaro, Jr., is mentally and physically disabled. He was and is not, capable of making such life altering decisions.
This was a kangaroo court sentencing with clear bias and discrimination toward a disabled individual. Anthony Jr.’s father and his advocate, Darren Aquino ( Advocates for Disabled Americans, Veterans, Police, Firemen & Families) were present. However, the advocate was not recognized and not allowed to testify. Judge Mc Donough stated that Passaro, Jr., was aware of the proceedings since there was a tear coming from his eye during the sentencing.
Judge McDonough is not a medical professional, nor does he have the medical expertise or license needed to diagnose the condition of a disabled individual. Input from medical professionals was not taken into consideration. There were 3 medical professionals, psychiatrists, that stated with absolute certainty through medical and clinical evidence that Passaro, jr. had no idea what he was doing. The medical documentation provided by these professionals was not considered. The Judge literally played doctor from the bench. He did not acknowledge Passaro Jr.’s disability, did not allow 3rd party input as per the ADA ( The Americans with Disabilities Act). Mr. Passaro Jr., was clearly denied fair and equal treatment under due process law.
No one advocating on behalf of Passaro, Jr., believes that the murder of his wife was not a tragedy. We all believe in justice. However, we are advocating for the humane treatment of a mentally and physically disabled individual. We are advocating for justice to be applied within the guidelines of the law. We are advocating for the Federally mandated law, The Americans with Disabilities Act to be applied for this individual that was not allowed to practice his due process rights. All those that had the authority, responsibility and privilege to apply the law and invoke his right, displayed utter ignorance and malice toward Anthony Passaro, Jr. and the entir e Passaro family, while proceeding with this case. Everyone should be reminded that Passaro, Jr., entered the Ulster county facility mentally incompetent, but, physically able to walk. He is now bed-ridden and unable to vocalize. What happened to the medical care due any individual under the Institutionalized Persons Act, 28 U.S.C. 1997 and 1991?
Andrew Kossover, a public defender was appointed to Passaro Jr’s case. Mr. Kossover had vital information regarding this case, such as information and the readiness of the testimony of the National Chief Advocate, and his assistant, former disabled 911 police officer ( NYPD 20 years), after an hour visit with Mr/ Kossover. They infmed him with the facts involving Passaro Jr’s mental health history, which would have supported the mental illness diagnosis, which would have seen to it that he would have been tried as a mentally ill person and not a hardened criminal. Whose attorney was he? The State’s additional attorney? Were there 3 people against Mr. Passoro, jr,? Judge McDonough, DA Conwright and Andrew Kossover,? His own attorney concealing exculpatory evidence which would have supported a legitimate defense of insanity. When the National Chief signaled at the sentencing, (while Passaro jr. lay oblivious and incoherent to the proceedings), that he wanted to speak and object since the judge was making a medical dx at a sentencing hearing, Kossover signaled back “no”. Mr. Kossover decided without the input of Passaro sr (who is also the power of Attorney for his mentally disabled son) and the advocate that the trial would have no jury. You cannot make a decision regarding a mentally disabled person on your own, there has to be a 3rd party, non-biased, present to ensure that the disabled person has understood the situation. However, after Mr. Kossover, defendant’s attorney, made this decision and then told Passaro sr. that this was what he was doing and that this decision was best, that they are going forth with a non jury trial. There could have been other alternatives, there could have been a Huntley Hearing, there could have been a jury trial and Mr. Kossover told mr. Passaro Sr. that this is “a political situation and that the judge has children the age Passaro jr.’s. The question is if Mr. Kossover is qualified to represent and defend someone that is so mentally disabled as Passaro Jr.National chief Advocate of ADA VETs, Darren Aquino, says no. There is foul play here and we will get to the bottom of it. No disabled person in this country will be deprived fair and equal justice under the law, not under our watch.
Either the District Court, or the United States Supreme court will have to rule on these actions that have deprived Passaro jr of the fair and equal justice that is fdue any individual,.let alone a disabled institutionalized one. He received abuse and maltreatment while in the care of a state facility prior to any judgments or convictions. These actions resulted in a far more debilitating medical condition for Passaro Jr. He was deprioved the medical treatment and medication necessary for his treatment, as defined in his medical history. He is not being treated for the MS lesions on his brain, to say the least. He broke his hip, due to an unaccommodated facility, in the bathroom. He was left unattended and unassisted. He was left to lay in his own feces as a form of retaliation. His family was deprived of regular visits. There are many more medical conditions that have resulted from the abuse and neglect involved in this case. In their official capacity, they brutalized this mentally ill disabled person, where they had all taken a sworn oath in their official capacity to uphold his rights. Their actions of malice, discrimination, cruel and inhumane treatment and deprivation of medical treatment will not go unpunished. These are the real criminals. We demand justice.

Notice of the following violations of Anthony Passaro Jr., and Anthony Passaro Sr., under the Americans with Disabilities Act (28 USC, 1997, Institutionalized Person’s Act) along with ineffective communications, also retaliation against qualified individuals within the meaning as defined by the Department of Justice Mandate: Anthony Passaro, Jr. is a Qualified individual suffering from the effects of a major life activity; including, but not limited to:1) Mental illness, 2) Multiple Sclerosis, 3) Juvenile Diabetes
Anthony Passaro Sr., also a qualified individual within the meaning as defined by the Department of Justice Mandate is considered to be a disabled individual. These violations are violations of the Constitution of the United States, 1st, 4th, 5th and14th Amendments, not limited to, but beginning with; actions of retaliation against Anthony Passaro Sr.
In an attempt to secure right, just and adequate treatment for his son, Mr. Passaro, Sr. made numerous phone calls to the appointed and elected officials seeking protection and enforcement both of his rights and those of his severely disabled son, to the following; 1) Ulster County Correctional Facility, located at 380 Boulevard, Kingston, New York 12401. Mr. Passaro Sr., first sought help from the following responsible for the request made; 1) Lt. Taylor, Lt. Russo, where no result or response was received after several attempts, 2) Medical Facility located also at aforementioned address, supervising nurse Ellen Fitzpatrick, who not only refused his request, but retaliated against his son, administered the improper insulin and other medications, also withholding prescriptive medicines in an attempt to cause grave harm. Fully aware of his medical condition, Ms. Fitzpatrick was also abusive to both Mr. Passaro Jr., and Sr.
The next person Mr. Passaro Sr., reached out to was the acting warden, Ray Essevito, who was given disclosure of the full situation several times via telephone and letters written on behalf of Mr. Passaro Sr., who suffers from dyslexia. Mr. Passaro, Sr. addressed all of the concerns, inclusive of the bodily harm that came to Anthony Jr., as a result of the cited violations by the State Advocacy for the Disabled in Albany, NY. These violations being within the state of the New York, under constitutional content, are the responsibility of the Governor, Dave Patterson, but initially were the responsibility of Eliot Spitzer.
As a result of the ongoing violations under 28 USC, 1997-1, Mr. Passaro Sr., has not been allowed to visit or speak with his son (who cannot speak as a result of the inappropriate medical treatment rendered by the correctional facility) for the last twelve weeks. His son’s condition is further deteriorating and Mr. Passaro fears for his son’s life and further acts of reprisal for his whistle-blowing.
Advocates for Disabled Americans (ADA), has been advocating for the Passaro family since early 2000. They have been involved in the case of Anthony Jr. and his deceased wife (who also suffered from mental illness)and their children, Faith and Anthony, 8 and 11 years old, respectively. ADA has made numerous requests and has provided all of the following necessary and pertinent medical and general information to insure fair and equal treatment under the law, and more importantly, the cited constitutional laws to no avail. It is the intent of this organization collectively with the disabled members, who have suffered and continue to suffer grave harm through the willful and hateful acts of the aforementioned individuals towards the Passaro family.
Inclusive in this complaint is Peggie Lefretto, Assistant to the Commissioner of Corrections, and Amy Lowenstein of the State Disability Advocacy under the Governor, both failing in their official capacity to uphold, maintain and enforce the Disabilities Rights under the 14th Amendment, but not limited to.
There is a greater question of a Due Process violation by the presiding judge, Honorable Roger Donahue, regarding the fair and equal treatment of disabled persons under the law. The Honorable Judge Donahue allowed a State Police officer to testify on the record, stating that he had no knowledge that Mr. Passaro Jr., was mentally ill at the time of his request, or at any time. We are also aware that his required insulin was withheld from him until the police finished questioning him. This organization (ADA) was not allowed to testify to or furnish any of the facts regarding the case of Mr. Passaro Jr. Two attempts were made to communicate with these chambers to be part of this questionable trial, which took place without a jury, and without the best interest of disabled American, Anthony Passaro Jr.
We strongly disagreed with the decision and procedure, and believe that the trial should not have been held for Mr. Passaro Jr., without a jury.
It has always been the position of this organization (which polices the rights of the disabled) that fair and equal treatment under the law prevails for every disabled American, unlike this incident, where, together with defense council, Andrew Kossover (an 18b attorney) and District Attorney Conright, hateful and malicious actions were taken, which amounted to nothing other than a hate crime against people with disabilities, together with discrimination. The commonality between these three individuals and the responsibilities they share as government employees was to see that fair and equal treatment was absolute, upholding Mr. Passaro Jr’s right under the ADA, and to secure his safety, keeping him from any harm. These individuals collectively allowed and caused abusive, malicious, hateful acts resulting in severe physical harm to Mr. Anthony Passaro, Jr., causing the deterioration of his medical condition, which has lead to him being literally bed-ridden and unable to vocalize. He no longer has the ability to speak and is incoherent most of the time.
Additionally, the acts of these individuals has also caused Mr. Passaro, Sr. a great deal of anguish and stress. This has lead to increased blood pressure/hypertension resulting in emergency room visits by Mr. Anthony Passaro Sr,, who feared and continues to fear for
the life of his only son, Anthony Passaro, Jr.
The afore-named persons also failed to effectively communicate as defined under the Americans with Disabilities Act, Anthony Passaro, Jr., being mentally and physically disabled, and his father, Anthony Passaro Sr., suffering from both prostate cancer and dyslexia (a comprehensive disorder), are unable to communicate as would able bodied individuals.
In closing, as we intend to notify everyone responsible, along with the names unknown to us, the father ( Anthony Passaro, sr) is still being deprived of visitation right to his ailing son Anthony Passaro, jr, as an act of retaliation for reporting these violations to Internal Affairs, Congressional Offices and other affiliated offices which are responsible to take action under the Americans with Disabilities Act. The appointed and elected officials governing and responsible for these offices swore a solemn oath to protect and defend the Constitution of the United States against all enemies foreign and domestic.
Anthony Passaro, jr., was blatantly, hatefully and maliciously deprived his rights as a qualified individual, with an anomaly of mental and physical disabilities as defined by law. These acts are a threat to every American with a disability. The actions of the presiding judge, to not acknowledge or disregard the severity of Anthony Passaro, jr.’s disabilities is a willful act on his part. This raises the question of his ability to serve in such an important part of our justice system.
On behalf of the Passaro family, we intend to pursue justice under the 14th Amendment, along with seeking the removal of these vindictive, hateful, biased, judgmental individuals from their positions in society along with the caregivers that were responsible for medical treatment that was denied, changed without medical authorization for conditions that Anthony Passaro, jr. has suffered from for over 30 years. This includes auxiliary aids that they refused to provide for over a year.
The State Advocacy for Disabled limited the services it would provide at the time, for an allegedly charged individual with a crime of murder. The responsibility of this agency was to implement a federal mandate to its fullest, it did not. It shares a responsibility and a Civil liability as well.
The father, Anthony Passaro, sr., who suffers from dyslexia, a processing disorder that hinders his ability to write, did everything to the best of his ability to communicate. Due to the distress and abuse that his son had been suffering, Passaro, sr., called on friends and family and this Advocacy since all of the above mentioned individuals, fully aware of his inability to articulate on paper, demanded his complaints in writing, another violation against Mr. Passaro, another retaliation to further deny him and his son appropriate services. The State agency was also aware of the Federal mandate of the Institutionalized Persons Act 28 U.S.C. 1997. They deprived him this full protection. These individuals are responsible for Anthony Passaro, jr.’s present condition resulting from the care and treatment not given.
We intend to pursue this case to the fullest at all costs on behalf of all the disabled individuals in the United States of America.

The next person Mr. Passaro Sr., reached out to was the acting warden, Ray Essevito, who was given disclosure of the full situation several times via telephone and letters written on behalf of Mr. Passaro Sr., who suffers from dyslexia. Mr. Passaro, Sr. addressed all of the concerns, inclusive of the bodily harm that came to Anthony Jr., as a result of the cited violations by the State Advocacy for the Disabled in Albany, NY. These violations being within the state of the New York, under constitutional content, are the responsibility of the Governor, Dave Patterson, but initially were the responsibility of Eliot Spitzer.
As a result of the ongoing violations under 28 USC, 1997-1, Mr. Passaro Sr., has not been allowed to visit or speak with his son (who cannot speak as a result of the inappropriate medical treatment rendered by the correctional facility) for the last twelve weeks. His son’s condition is further deteriorating and Mr. Passaro fears for his son’s life and further acts of reprisal for his whistle-blowing.
Advocates for Disabled Americans (ADA), has been advocating for the Passaro family since early 2000. They have been involved in the case of Anthony Jr. and his deceased wife (who also suffered from mental illness)and their children, Faith and Anthony, 8 and 11 years old, respectively. ADA has made numerous requests and has provided all of the following necessary and pertinent medical and general information to insure fair and equal treatment under the law, and more importantly, the cited constitutional laws to no avail. It is the intent of this organization collectively with the disabled members, who have suffered and continue to suffer grave harm through the willful and hateful acts of the aforementioned individuals towards the Passaro family.
Inclusive in this complaint is Peggie Lefretto, Assistant to the Commissioner of Corrections, and Amy Lowenstein of the State Disability Advocacy under the Governor, both failing in their official capacity to uphold, maintain and enforce the Disabilities Rights under the 14th Amendment, but not limited to.
There is a greater question of a Due Process violation by the presiding judge, Honorable Roger Donahue, regarding the fair and equal treatment of disabled persons under the law. The Honorable Judge Donahue allowed a State Police officer to testify on the record, stating that he had no knowledge that Mr. Passaro Jr., was mentally ill at the time of his request, or at any time. We are also aware that his required insulin was withheld from him until the police finished questioning him. This organization (ADA) was not allowed to testify to or furnish any of the facts regarding the case of Mr. Passaro Jr. Two attempts were made to communicate with these chambers to be part of this questionable trial, which took place without a jury, and without the best interest of disabled American, Anthony Passaro Jr.
We strongly disagreed with the decision and procedure, and believe that the trial should not have been held for Mr. Passaro Jr., without a jury.
It has always been the position of this organization (which polices the rights of the disabled) that fair and equal treatment under the law prevails for every disabled American, unlike this incident, where, together with defense council, Andrew Kossover (an 18b attorney) and District Attorney Conright, hateful and malicious actions were taken, which amounted to nothing other than a hate crime against people with disabilities, together with discrimination. The commonality between these three individuals and the responsibilities they share as government employees was to see that fair and equal treatment was absolute, upholding Mr. Passaro Jr’s right under the ADA, and to secure his safety, keeping him from any harm. These individuals collectively allowed and caused abusive, malicious, hateful acts resulting in severe physical harm to Mr. Anthony Passaro, Jr., causing the deterioration of his medical condition, which has lead to him being literally bed-ridden and unable to vocalize. He no longer has the ability to speak and is incoherent most of the time.
Additionally, the acts of these individuals has also caused Mr. Passaro, Sr. a great deal of anguish and stress. This has lead to increased blood pressure/hypertension resulting in emergency room visits by Mr. Anthony Passaro Sr,, who feared and continues to fear for
the life of his only son, Anthony Passaro, Jr.
The afore-named persons also failed to effectively communicate as defined under the Americans with Disabilities Act, Anthony Passaro, Jr., being mentally and physically disabled, and his father, Anthony Passaro Sr., suffering from both prostate cancer and dyslexia (a comprehensive disorder), are unable to communicate as would able bodied individuals.
In closing, as we intend to notify everyone responsible, along with the names unknown to us, the father ( Anthony Passaro, sr) is still being deprived of visitation right to his ailing son Anthony Passaro, jr, as an act of retaliation for reporting these violations to Internal Affairs, Congressional Offices and other affiliated offices which are responsible to take action under the Americans with Disabilities Act. The appointed and elected officials governing and responsible for these offices swore a solemn oath to protect and defend the Constitution of the United States against all enemies foreign and domestic.
Anthony Passaro, jr., was blatantly, hatefully and maliciously deprived his rights as a qualified individual, with an anomaly of mental and physical disabilities as defined by law. These acts are a threat to every American with a disability. The actions of the presiding judge, to not acknowledge or disregard the severity of Anthony Passaro, jr.’s disabilities is a willful act on his part. This raises the question of his ability to serve in such an important part of our justice system.
On behalf of the Passaro family, we intend to pursue justice under the 14th Amendment, along with seeking the removal of these vindictive, hateful, biased, judgmental individuals from their positions in society along with the caregivers that were responsible for medical treatment that was denied, changed without medical authorization for conditions that Anthony Passaro, jr. has suffered from for over 30 years. This includes auxiliary aids that they refused to provide for over a year.
The State Advocacy for Disabled limited the services it would provide at the time, for an allegedly charged individual with a crime of murder. The responsibility of this agency was to implement a federal mandate to its fullest, it did not. It shares a responsibility and a Civil liability as well.
The father, Anthony Passaro, sr., who suffers from dyslexia, a processing disorder that hinders his ability to write, did everything to the best of his ability to communicate. Due to the distress and abuse that his son had been suffering, Passaro, sr., called on friends and family and this Advocacy since all of the above mentioned individuals, fully aware of his inability to articulate on paper, demanded his complaints in writing, another violation against Mr. Passaro, another retaliation to further deny him and his son appropriate services. The State agency was also aware of the Federal mandate of the Institutionalized Persons Act 28 U.S.C. 1997. They deprived him this full protection. These individuals are responsible for Anthony Passaro, jr.’s present condition resulting from the care and treatment not given.
We intend to pursue this case to the fullest at all costs on behalf of all the disabled individuals in the United States of America.

Sir, this MTA systom is something we must investigate deaply. Is there a way I can get more involved in helping to do something in the investigation. It seem like every year they are in a deficit they raise the fares and tolls to close that gap but then are back in the red, just do not understand. They open up for public hearings they waist money on having them at hotels that cost an arm and leg. We must get to the heart of this situation so we can close the door. Afew years ago they found two sets of books, never heard anything else about that. there has to be an end to this cost of living, tolls, food, metro cards go up 10 to 15 precent but pay checks for the little people go up 0 to 3 percent it does not cover all the increases we encounter. please let me know we have to do something about the future of the students they have to travel to get an education, they will will not go to school or they will drop out is this what we want

IT'S THE LEST OF EFFORTS MADE TO MOTIVATE YOUNGSTERS TO GO TO SCHOOL...TAKING THE METROCARD AWAY WILL ONLY BOLSTER THEIR CURRENT NEGATIVE ATTITUDE TOWARDS ATTENDING SCHOOL.
The mta is using the cutting of our student's metro card as a scapegoat and not to close a financial gap. This action will keep our future generation and leaders in an illiterate age though we should be advancing in education.
If the mta wants to narrow their budget gap they need to consider all the free rides that they are giving to the families and extended families of their employees. Every year I hear from the mta that they have a surplus and within the same breath we hear miscalculations and fare hikes. I have seen many passengers board the bus and trains without paying because they show the card with the BOLD U on it.
Cutting the students’ metro card will not propel our students into the future, but will pull the future generation backwards, whereby leaving us without accountable educated leaders to guide our communities. Now think, where will our higher educational and country leaders be? Parents will now have to choose their poison. Should they pay their bills, put food on their tables or send their children to school to ensure a better future. This is not only for a single parent, but also for households where one parent has been laid off due to our current economic situation, this will become added financial stress. This is not an overnight cure for a prolonged problem. It is a disaster in the making with a forcible economic depression as an outcome and we need not return to the great depression phase.
Consider this, we as a country is applauding a drop in criminal activities and the accomplishments of our educational system but if we allow the mta to remove the free metro cards, then we can say hello to the increase in criminal activities and goodbye to our current accomplishments and our country will no long be seen as a nationwide leader. This will then eventually cause more money because of the need for police officers to deter students from idling on the streets and jumping the turn-stops to get to school, increase in jailhouse population and increase of patients in the hospital due to stress.
There is no good outcome if the metrocards are taken away. We are in a recession and the mta needs to consider that because of a fare hike in 2009, rider-ship decreased therefore if parents have to put out more for less, will they be able to close the g-a-p we as a community will look for an alternate solution.

Kids go out of their school zones because not all schools offer the field in which the child is looking to go into. Also (unfortunately)some of the schools in the ones neighborhood is a good one. If all schools under the NY Bd of Ed made their schools equal this won't be a problem. Our government needs to stop trying to make children pay for the misdeeds of adults (I speak of those on the MTA Board) monies are being mismanaged from the bottom up. Those that sit on the Board no absolute nothing about what goes on in the subways because they don't use the subway. If they did their budget might not be in the mess that it's in now. From what I have heard the majority of the Board Member are multi-millioniares to billionaires. Who still collecting hefty paychecks. Why don't the get paid a $1 for the year like Mayor Bloomberg. That could definitely save us and our kids from all these cuts. Lets stop taking the sides of those that aren't looking at our best interest or that of our kids. Kids need an education, not being told that their not even worth fighting for.
